DISCLOSURE AND eDISCLOSURE

TECSA has created this page to provide an on-going repository of knowhow on Disclosure and eDisclosure for TCC Users (and beyond) assisting less experienced practitioners and providing the latest tips and tricks.

TECSA accepts no liability for the content of this page, but encourages members to contribute constructive and informative material so that Disclosure and eDisclosure practice becomes more streamlined and cost effective for the benefit of clients and lawyers alike. Input also helps TECSA develop its proposed eDisclosure Protocol to truly reflect best practice.

Disclosure Pilot and eDisclosure Protocol Pack

On 1 January 2019, a new two-year disclosure pilot scheme started in the Business and Property Courts across England and Wales. The scheme is ambitious, aiming to address the costs and challenges of the existing disclosure regime, to embrace the use of legal technology and to encourage a more bespoke approach.

This inevitably incorporates eDisclosure which is now the most commonly used method of disclosure.

The pilot applies from the Commencement Date for two years to existing and new proceedings in the Business and Property Courts of England and Wales and the Business and Property Courts in Birmingham, Bristol, Cardiff, Leeds, Liverpool, Manchester and Newcastle.

Practice Direction 51U details of the Pilot:

On 1 October 2020 Version 0.2 of the eDisclosure Protocol and Guidelines was launched and is found below. This Protocol still operates alongside the Pilot.
