TECSA’s Adjudication Service

Adjudication has been the primary means of deciding ‘first tier’ disputes in the construction industry for many years and TECSA has been at the heart its development since inception. TECSA produced the first set of compliant adjudication rules and was active in lobbying government on the nature and form of both the primary and secondary legislation. TECSA contributed to both government and industry bodies on their review of its operation.

TECSA provides a broad range of adjudication services to its members and their clients:

  • Since 2009, TECSA has operated its own high quality adjudication service for disputes of all values. Our service has constantly evolved to reflect changes to relevant legislation and industry needs
  • TECSA maintains a multi-disciplinary list of experienced adjudicators, many of whom are trained by TECSA, who are subjected to periodic assessments. The Chairman, or her designated deputies, make nominations from this list
  • It has successfully launched a Low Value Disputes (LVD) Adjudication Service for claims for payment of up to £100,000. Following a successful pilot in 2019, it is now an important new facet in TECSA’s Adjudication offering
  • The LVD Adjudication Service is aimed at giving parties who wish to refer disputes to adjudication certainty as to the costs of the Adjudicator for claims for fixed amounts of up to £100,000 (excluding VAT and interest). It limits the fees which the Adjudicator can charge. See Summary of TECSA LVD Service for the criteria below.
  • TECSA’s own Adjudication rules, available to download below (currently version 3.2.3 which came into force on 30 November 2023) can be used in place of the Adjudication Rules in the Government Scheme for Construction Contracts
  • TECSA have produced a guidance note for TECSA LVD users and guidance notes for Adjudicators appointed under the LVD Adjudication Service – see below
  • TECSA is committed to improving the diversity of its panel of Adjudicators and is a signatory to the Equal Representation in Adjudication Pledge
